Legislative Decree 231 of 2001

Base Digitale Platform has consistently combined its expertise in technical and technological innovation with Corporate Governance based on a meticulous organisational and management model. In line with what is sanctioned by Legislative Decree no. 231/01 et seq., tools have been adopted to focus on the administrative responsibility of the company, making it independent from the responsibility of natural persons acting in the name and on behalf of the company.

 

The Organisational, Managerial and Control Model

The Board of Directors’ approval of a system like the Modello di Organizzazione, Gestione e Controllo (MOG, or the Organisation, Management and Control Model), as specified in the legislation, represents the guarantee of an approach aiming to spread a culture of legality and responsibility amongst the directors, managers, employees and collaborators. This ensures that each corporate process leads back to a suitable level of conduct, the honesty and validity of which can always be verified, ex ante and ex post. The quality of this is ensured by the integration of the organisational and managerial model pursuant to the voluntary conformity certifications of the ISO 9001 standard.

 

GDPR, covering responsibility and accountability

The implementation of the directives provided by the Legislative Decree number 231/01 anticipate the pivotal concept of accountability introduced on 25 May 2018 by the new European Regulation regarding the protection of personal data processing. The GDPR (General Data Protection Regulation), in fact, with the term accountability combines the meaning of "responsibility" with that of "demonstrating, giving account" of the measures put in place for this purpose. This is something that Base Digitale Platform has been doing for some time now, not only in the field of privacy, but also with regard to health and safety in the workplace, environmental crimes, corruption and all the others covered by the decree.
